• Any related software, documentation, and content provided by the Owner

What the User Should Know at a Glance

Terms of Use

By downloading, installing, or using Clean My Email ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Unless otherwise specified, the terms of use detailed in this section apply generally when using Clean My Email. Single or additional conditions of use or access may apply in specific scenarios and in such cases are additionally indicated within this document.

Users must be at least 13 years of age (or 16 in the European Union) to use the Service.

Account Registration

To use Clean My Email, you must sign in with a valid Google account that has Gmail enabled. By registering, Users agree to be fully responsible for all activities that occur under their account.

Conditions for Registration

Registration of User accounts on Clean My Email is subject to the conditions outlined below:

• Users must provide complete and truthful information
• Users may not misrepresent their identity or affiliation with any person or organization
• Users are responsible for maintaining the security of their Google account credentials
• Users must immediately report any suspected unauthorized access to their account

Account Termination

Users may terminate their account at any time by revoking the App's access through their Google Account settings and deleting the App from their device.

Account Suspension and Deletion

The Owner reserves the right to suspend or terminate User accounts at any time and without notice if the Owner considers it appropriate, including but not limited to violations of these Terms. Account suspension or deletion shall not entitle Users to any claims for compensation, damages, or reimbursement.

Content on Clean My Email

Rights Regarding Content on Clean My Email

Unless where otherwise specified or clearly recognizable, all content available on Clean My Email is owned or provided by the Owner or its licensors. The Owner undertakes its utmost effort to ensure that the content provided on Clean My Email infringes no applicable legal provisions or third-party rights.

Content Provided by Users

The Owner allows Users to upload, share, or provide their own content. By providing content to Clean My Email, Users confirm that they are legally allowed to do so and that such content does not violate any applicable laws or third-party rights.

Liability for Provided Content

Users are solely liable for any content they upload, post, share, or provide. Users acknowledge and accept that the Owner does not filter or moderate such content. However, the Owner reserves the right to remove, delete, or block such content at its sole discretion.

Access to External Resources

Through Clean My Email, Users may have access to external resources provided by third parties, including Google's Gmail API and unsubscribe links within emails. Users acknowledge and accept that the Owner has no control over such resources and is therefore not responsible for their content and availability.

Conditions applicable to any resources provided by third parties, including those applicable to any possible grant of rights in content, result from each such third parties' terms and conditions or, in the absence of those, applicable statutory law.

Acceptable Use

Clean My Email and the Service may only be used within the scope of what they are provided for, under these Terms and applicable law.

Users are solely responsible for making sure that their use of the Service does not violate any applicable law, regulations, or third-party rights.

The Owner reserves the right to take any appropriate measure to protect its legitimate interests including denying Users access to the Service, terminating contracts, reporting any misconduct performed through the Service to the competent authorities.

Prohibited Uses

Users may not:

• Use the Service to violate any applicable laws or regulations
• Reverse engineer, decompile, or disassemble the App
• Use the Service in any way that could damage, disable, or impair the Owner's servers or networks
• Use automated scripts or bots to interact with the Service beyond its intended functionality
• Attempt to gain unauthorized access to any portion of the Service
• Use the Service to send spam or unsolicited communications
• Impersonate any person or entity or misrepresent your affiliation

Software License

Any intellectual or industrial property rights, and any other exclusive rights on software or technical applications embedded in or related to Clean My Email are held by the Owner and/or its licensors.

Subject to Users' compliance with and notwithstanding any divergent provision of these Terms, the Owner grants Users a revocable, non-exclusive, non-sublicensable, and non-transferable license to use the software and/or any other technical means embedded in the Service within the scope and for the purposes of Clean My Email and the Service offered.

This license does not grant Users any rights to access, usage, or disclosure of the original source code. All techniques, algorithms, and procedures contained in the software and any documentation thereto related is the Owner's sole property.

Terms and Conditions of Sale

Paid Products

Clean My Email offers both free and paid features. Premium features are available through paid subscriptions processed via Apple's App Store or Google Play.

Product Description

Prices, descriptions, and availability of Products are outlined in the respective sections of Clean My Email and are subject to change without notice.

Purchasing Process

Any steps taken from choosing a Product to order submission form part of the purchasing process. The purchasing process is handled by Apple's App Store or Google Play, and their respective terms apply.

Prices

Users are informed of the final price, including any applicable taxes, prior to confirming a purchase. Prices may change at any time; existing subscribers will be notified before price changes affect their renewal.

Subscriptions

Paid features are provided on a subscription basis. Subscriptions allow Users to access the premium features for the duration of the subscription period.

Subscription Periods

Subscriptions renew automatically for the same period unless cancelled. Users can manage their subscriptions through their App Store or Play Store account settings.

User Rights

Right of Withdrawal (EU Consumers)

EU Consumers have 14 days to withdraw from a contract without giving any reason. The withdrawal period expires 14 days after the day of the conclusion of the contract. To exercise the right of withdrawal, Users must inform the Owner of their decision by contacting the Owner through the contact details provided in this document.

Effects of Withdrawal

If the User withdraws from this contract, the Owner shall reimburse all payments received from the User without undue delay and in any event not later than 14 days from the day on which the Owner is informed about the User's decision to withdraw.

UK Consumer Rights

UK Consumers have 14 days to cancel a contract without giving any reason. The cancellation period expires 14 days after the day of the conclusion of the contract.

Brazilian Consumer Rights

Brazilian Consumers have the right to withdraw from a contract within 7 days of signing it or receiving the product or service, whichever occurs last (right of regret).

Refund Processing

As purchases are processed through Apple's App Store or Google Play, refund requests should be directed to Apple or Google respectively. The Owner does not have direct access to billing information.

Guarantees

Legal Guarantee of Conformity for Digital Products Under EU Law

Under EU law, the Owner provides a legal guarantee of conformity for digital content and digital services. This guarantee covers any lack of conformity existing at the time of supply that becomes apparent within 2 years of supply.

Legal Guarantee for Brazilian Consumers

Brazilian Consumers benefit from a legal guarantee of conformity under the Brazilian Consumer Protection Code for services provided.

Liability and Indemnification

Indemnification

The User agrees to indemnify and hold the Owner and its subsidiaries, affiliates, officers, directors, agents, co-branders, partners, and employees harmless from and against any claim or demand, including reasonable attorney's fees, made by any third party due to or arising out of the User's content, use of or connection to the Service, violation of these Terms, or violation of any third-party rights.

Limitation of Liability

Unless otherwise explicitly stated and without prejudice to applicable law, Users shall have no right to claim damages against the Owner or anyone acting on behalf of the Owner.

The limitations and exclusions herein do not apply to liability for death or personal injury, fraudulent misrepresentation, gross negligence, or willful misconduct.

Australian Users

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy which the User may have under the Competition and Consumer Act 2010 (Cth) or any similar State or Territory legislation which cannot be excluded, restricted, or modified.

US Users

Disclaimer of Warranties

THE SERVICE IS PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS. USE OF THE SERVICE IS AT USERS' OWN RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE OWNER EXPRESSLY DISCLAIMS ALL CONDITIONS, REPRESENTATIONS, AND WARRANTIES — WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF THIRD-PARTY RIGHTS.

Limitations of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE OWNER OR ITS SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, AGENTS, CO-BRANDERS, PARTNERS, SUPPLIERS, AND EMPLOYEES BE LIABLE FOR:

• Any indirect, punitive, incidental, special, consequential, or exemplary damages
• Any loss of profits, goodwill, use, data, or other intangible losses
• Any damage, loss, or injury resulting from hacking, tampering, or other unauthorized access to or use of the Service
• Any emails deleted, archived, or modified through the Service

In any case, the Owner's liability shall not exceed the total payments made by the User in the twelve (12) months preceding the claim.

Common Provisions

No Waiver

The Owner's failure to assert any right or provision under these Terms shall not constitute a waiver of any such right or provision.

Service Interruption

To ensure the best possible service level, the Owner reserves the right to interrupt the Service for maintenance, system updates, or any other changes, informing Users appropriately when possible.

Service Reselling

Users may not reproduce, duplicate, copy, sell, resell, or exploit any portion of Clean My Email and its Service without the Owner's express prior written permission.

Privacy Policy

To learn more about the use of their Personal Data, Users may refer to the Privacy Policy of Clean My Email.

Intellectual Property Rights

All trademarks, nominal or figurative, and all other marks, trade names, service marks, word marks, illustrations, images, or logos appearing in connection with Clean My Email are the exclusive property of the Owner or its licensors.

Changes to These Terms

The Owner reserves the right to amend or otherwise modify these Terms at any time. In such cases, the Owner will appropriately inform the User of these changes. Changes will only affect the relationship with the User from the date communicated to Users onwards.

Assignment of Contract

The Owner reserves the right to transfer, assign, dispose of by novation, or subcontract any or all rights or obligations under these Terms, taking the User's legitimate interests into account.

Severability

Should any provision of these Terms be deemed or become invalid or unenforceable under applicable law, the invalidity or unenforceability of such provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect.

Governing Law

These Terms are governed by the law of the place where the Owner is based, as disclosed in the relevant section of this document, without regard to conflict of laws principles.

Prevalence of National Law

However, regardless of the above, if the law of the country that the User is located in provides for a higher applicable consumer protection standard, such higher standards shall prevail.

Exception for Consumers in Europe

If the User qualifies as a European Consumer, the law of the country in which the User has their habitual residence shall apply.

Exception for Consumers in Switzerland

If the User qualifies as a Consumer in Switzerland, Swiss law shall apply.

Exception for Consumers in Brazil

If the User qualifies as a Consumer in Brazil, Brazilian law shall apply.

Venue of Jurisdiction

The exclusive competence to decide on any controversy resulting from or connected to these Terms lies with the courts of the place where the Owner is based, as displayed in the relevant section of this document.

Exception for Consumers in Europe

The above does not apply to any Users that qualify as European Consumers, nor to Consumers based in the United Kingdom, Switzerland, Norway, or Iceland.

Exception for Consumers in Brazil

The above does not apply to Users in Brazil that qualify as Consumers.

Dispute Resolution

Amicable Dispute Resolution

Users may bring any disputes to the Owner who will try to resolve them amicably. While Users' right to take legal action shall always remain unaffected, in the event of any controversy regarding the use of Clean My Email or the Service, Users are kindly asked to contact the Owner at the contact details provided in this document.

The User may submit the complaint to the Owner by email. The Owner will process the complaint without undue delay and within 2 business days of receiving it.

Online Dispute Resolution for Consumers

The European Commission has established an online platform for alternative dispute resolutions that facilitates an out-of-court method for resolving disputes related to and stemming from online sale and service contracts. As a result, any European Consumer or Consumer based in Norway, Iceland, or Liechtenstein can use such platform for resolving any dispute stemming from contracts entered into online.

Definitions

• Clean My Email (or this Application): The property that enables the provision of the Service.
• Agreement: Any legally binding or contractual relationship between the Owner and the User, governed by these Terms.
• Owner (or We): The natural person(s) or legal entity that provides Clean My Email and/or the Service to Users.
• Product: A good or service available through Clean My Email, such as subscription plans.
• Service: The service provided by Clean My Email as described in these Terms and on the platform.
• Terms: All provisions applicable to the use of Clean My Email and/or the Service as described in this document.
• User (or You): The natural person or legal entity using Clean My Email.
• Consumer: A User qualifying as a natural person who accesses goods or services for personal use.
• European Consumer: A Consumer located in the European Union.
